The website www.myacollection.com refers to the online store, with online presence of the company under the name “MYA IKE” and the trade mark “MYA COLLECTION” (VAT No. 801101517, A ATHINON). The company’s headquarters are located at 33 Anaxagora Street, Tavros, 177 78 in Greece.

The company “MYA COLLECTION” aims to offer first-class service to users and consumers of the website on a daily basis. The creation of this website marks the beginning of an advanced form of communication between the company and consumers. Furthermore, the online store is intended for all internet users who wish not only to receive immediate information about the company’s products, but also those who intend to purchase from the online store what is provided from the available stock.

“MYA COLLECTION” places particular emphasis on immediate and satisfactory customer service, with a continuous functional and responsible manner based on business activity and mutual trust between the consumer and the company.

The stated terms and conditions fully comply with current European and Greek legislation. Users must be aware of the company’s right to modify the needs of the current terms at the point where it either legally benefits the obligations of the parties involved or the completed situations. Consumers are obliged to periodically check the current terms and conditions and are fully responsible regarding the use of the website.

Users of the website acknowledge that they have officially read the current terms and agree with what is stated. The terms and conditions of the website set the terms of use of the website and the services defined in relation to the sales agreement that applies between the consumer and the company. The company “MYA COLLECTION” has the right to temporarily or permanently suspend all its services without notice at its own discretion.

  1. Personal Data Protection

In order to carry out any transaction through the “MYA COLLECTION” online store or submit an online order for products, customers will be asked to provide certain personal data. By using the website, exclusive permission is granted to the company “MYA COLLECTION” to process the relevant personal data and confirm that all information is correct and accurate.

When an online order is placed, the customer will be asked to enter their full name, delivery address for shipping the products, contact phone number (any specified by the customer), email address and in case the customer wishes to pay electronically, the card number, expiration date and the 3 digits of the security code will be required. Without the above information, the online order cannot be completed.

Our company is obliged to process the above data in accordance with article 7A par. 1 (b) of legislation 2472/1997, in order to carry out the online order submitted by users and does not have the right to publish or sell these details to third parties, unless required for legal purposes regarding the withdrawal of data (Law 2225/1994) or in accordance with other obligations arising from the national implementation of directive 24/2006.

Customer personal data related to the bank (e.g. credit/debit card number) must be DELETED from the company’s electronic records immediately after completion of the order, in order to provide additional security to the customer.

  1. Security

The website www.myacollection.com uses the EUROBANK TLS protocol with 256-bit key. We protect our databases with an advanced Firewall and electronic identification technology. In this way, all banking information is encrypted so that it cannot be read or altered via the internet.

We note that we cannot promise complete avoidance of the use of customer information by unauthorized users and we will not assume responsibility in the event of theft or destruction (direct or indirect) of a user who illegally or unauthorized uses banking details.

In addition, MYA has no obligation for any damage that may be caused by viruses on the computer during the customer’s visit to our website. Please confirm that you have antivirus programs, firewalls and other protective programs.

  1. Products for sale

All product characteristics as well as other details are listed on our website and the customer can find similar information by following the search, typing the name of the corresponding product.

“MYA COLLECTION” always tries to present all website products as analytically and accurately as possible. There are cases where information on the website may be incorrect or incomplete. The customer has the right to report errors and request clarifications for the purpose of improving our website. Given the presentation of certain products on our website and the variety of colors and fabrics, these may differ from the actual product. In this case, the customer has the right to replacement of the product or return.

B. PRODUCT ORDERS

Placing an order through the online store means that you enter into a distance sales agreement, governed by the legal framework of Law 2251/1994 as in force regarding Consumer Protection.

You can place a valid order through our online store provided that you are legally competent according to the Greek Civil Code (which means you are eighteen years old and above and not under judicial guardianship regarding sales agreements). Representatives of legal entities may also place orders. “MYA COLLECTION” reserves the right to claim the price of the sales agreement or any damages/losses incurred from the sales agreement from supervisors or guardians of legally incompetent persons.

  1. ORDER PROCESS VIA E-SHOP:

After making your selection regarding the product you wish to purchase, you will need to proceed with entering your details on the online platform in order to proceed with the purchase.
You need to accept the terms of use and purchase by pressing the “ACCEPT” button as it appears on our website to all users.

Acceptance of an order does not legally mean that the purchase agreement has been completed but that we are given access to your details and we reserve the right to inform you that your order cannot be executed. The order is completed when your details have been accepted and the package has been shipped.

All products are subject to availability. In case of technical problems with the products, we inform you of similar products or better products that can replace your original selection. If another product does not serve you, we can proceed with a refund.

To facilitate your purchase of products from our online store, www.myacollection.com, the following payment methods are available.

Credit/debit card: Charge to your credit/debit card. The charge to your credit/debit card is made on the date we start processing your request for purchase. Our website, www.myacollection.com, has taken all necessary measures to protect your personal data during credit/debit card transactions and all cardholders are subject to validity checks.
PayPal: PayPal as a payment method requires having a PayPal account.
Bank deposit: By selecting bank deposit as payment method, your order will remain valid for 48 hours from the moment the order confirmation email is sent. During this time period, you must send us proof of deposit (to info@myacollection.com) of the exact amount. If we do not receive proof 48 hours after placing your order, the order will be automatically canceled.

With any payment method, there is the option of retail receipt or invoice. The invoice is issued for companies and freelancers, after we receive the following information: Company name, VAT number and profession for self-employed. The invoice/retail receipt will be sent to you together with your order.

Shortly before completing your order, our company informs the customer through our website of the essential details of the product, price, shipping costs, payment methods, duration and discount amount if any, and the withdrawal right within 14 days from shipment of the product.

After submitting the order form, consumers will receive an online copy of their order which they can save.

All prices are shown in the relevant field, including VAT. The website www.myacollection.com reserves the right to change current prices without notice. Discounts are valid until products are exhausted.

Non-European customers must accept any additional charges that may arise from customs differences or currency differences, for which our company bears no responsibility.

The pre-order service is provided exclusively by MYA COLLECTION and allows customers to reserve and order a product before it becomes fully available on our website www.myacollection.com

The conditions for pre-orders are as follows:

Availability
Products available for pre-order are sold with priority as they are usually available in limited quantity.

Delivery
We aim to ship pre-order products within two months, however you will remain informed about shipping periodically.

Your order will leave our offices when and if all items of the pre-order are available. In case something is available in an order that includes pre-order products, it will be shipped when all items are available. We do not perform split shipments.

Responsibility for the products is transferred to you from the moment you or a third party, other than the courier, has come into contact with the item or has modified it. Ownership of the product comes to you upon full recovery of all amounts provided that the company has respected the product, including shipping costs.

D. Consumer obligations

Consumers are required to comply with the terms and conditions of Greek, European and national legislation as well as relevant governmental regulations concerning telecommunications and to refrain from any illegal and violent behavior. The consumer bears full responsibility if misuse of the website or services occurs. In case “MYA COLLECTION” becomes involved in any illegal activity or is obliged to pay compensation due to violation of customer obligations, the customer shall be obliged to compensate “MYA COLLECTION”. Each customer is responsible for their personal passwords and accepts the risk of password violation by third parties.

“MYA COLLECTION” is not obliged to control messages, information and content posted online by other consumers and bears no responsibility for such content. However, our company may from time to time review content posted by customers and may accept or reject/delete posts. Consumers are required not to use the website to post a) political or other unfair, violent, illegal, obscene, incorrect, false, aggressive, threatening messages b) spam, chain letters, false emails and promotional messages c) advertisements of any nature d) personal data (address, phone etc.) allowing unauthorized use of personal data e) information similar or related to the above.

The website must not be used by consumers to: a) send advertising messages b) violate personal data or rights c) present false data belonging to other users d) confront another person, user of the website or employee of “MYA COLLECTION” e) engage in illegal activities z) collect personal data of the online store and information for other consumers h) send, post or transfer illegal content that may cause criminal consequences for the company or users θ) send, post or transfer content contrary to social values and minority rights ι) send, post or transfer content that consumers are not entitled to possess due to legislation κ) send, post or transfer content containing trademark, copyright or other property rights of others λ) send, post or transfer content containing viruses or illegal codes μ) targeted or non-targeted violation of laws ν) any kind of harassment.

In case of exercise of any of the above, MYA bears no responsibility and is not obliged to accept such content.

Furthermore, consumers hereby agree to indemnify MYA for any illegality between them and third parties due to content published or transferred through the website in case of inaccurate registration of data or violent behavior. Any use contrary to the above will result in deletion of content and account without notice. If “MYA COLLECTION” is notified that content causes damage, it will cooperate with authorities.

“MYA COLLECTION” is not responsible in any case for communication between customers and third-party service providers advertised on the website and any commercial transaction resulting from their relationship.

E. Intellectual property rights

All content of the website, including images, graphics, photographs, designs, texts, products, trademarks, symbols, is intellectual property of “MYA COLLECTION” and protected by Greek, European law and international conventions.

Any modification, copying, distribution, transfer, sale, republication, reproduction or exploitation of website content in any way is prohibited without written permission of “MYA COLLECTION”. Display of such content does not constitute transfer of license or usage rights.

Z. General Terms

ASSIGNMENT

This sales agreement and any contract, term and condition herein are binding and apply to the benefit of the parties and successors.

The customer may not assign this agreement in whole or part. However, “MYA COLLECTION” may assign or subcontract the agreement or rights to third parties at any time.

FORCE MAJEURE

Failure of “MYA COLLECTION” to perform obligations due to events beyond control including acts of God, war, terrorism, strikes, disasters etc. shall not constitute breach. If delay exceeds sixty (60) days, “MYA COLLECTION” will contact you to terminate and refund amounts.

WAIVER

No waiver of breach shall constitute waiver of subsequent breach.

SEVERABILITY

If any part of this agreement is unenforceable, it shall be replaced while remaining provisions remain binding.

MODIFICATION

The website www.myacollection.com reserves the right to modify or update these terms at its discretion.

GOVERNING LAW – JURISDICTION

Use of the website and the sales agreement are governed by Greek law.

All disputes shall be submitted to the Courts of Athens.
